Our NOAA Probationary Class Action

On June 30, Civil Service Law Center LLP filed a class action complaint in the U.S. District Court for the District of Maryland alleging that the mass termination of probationary employees at the National Oceanic and Atmospheric Administration (NOAA) in February 2025 violated the Privacy Act.  In particular, the lawsuit claims that, by asserting the employees were fired on the basis of poor job performance – without any supporting evidence or documentation – NOAA, along with the Department of Commerce, DOGE, OPM, and OMB, maintained and used inaccurate and incomplete personnel records.

The complaint is filed on behalf of a proposed class, defined as:

“All individuals who (1) were employed by the U.S. Department of Commerce, in the National Oceanic and Atmospheric Administration, in a probationary status (including trial periods or other types of probation) as of February 27, 2025; and (2) received a ‘Notification of Termination During Trial Period’ dated on or around February 27, 2025.”
